The legal team for Dr. Ekwow Spio-Garbrah claims it is unhappy by the Kumasi High Court’s decision to dismiss a $10 million defamation lawsuit it filed against Bernard Antwi Boasiako, the Ashanti Regional Chairman of the New Patriotic Party (Chairman Wontumi).
Nii Kpakpo Samoa Addo, the principal attorney representing Dr. Spio-Garbrah, told Citi News that his client has directed him to submit an appeal right now.
“The court has made a ruling about our lawsuit. We disagree with the ruling because we believe it is contrary to the weight of the evidence presented in court.
As a result, we are required under the instructions to appeal the verdict right away. Therefore, we anticipate that a notice of appeal will be submitted by tomorrow (July 29) or Monday (August 1, 2022), God willing. We’ll pursue the appeal tenaciously. It is apparent that we disagree with the ruling and believe it shouldn’t stand. ”
He declared that they are prepared to take the case all the way to the Supreme Court.
“We’ll take this case all the way to the highest courts. My client is adamant that this case will serve as an example. We have made up our minds.
Although he is the one who was being referred to by the defendant as a “thief,” Dr. Ekwow Spio-attorneys Garbrah’s say they are quite disappointed that a cost of GH150,000 was also awarded against him.
They are therefore appealing both the verdict and the costs that were assessed against them, according to Nii Kpakpo Samoa Addo.
“One of the things we would be appealing is the cost the court assessed against us. We would also appeal the costs that were given as well as the judgement, which we will be appealing against.
The representation of Dr. Spio-Garbrah maintains that Mr. Bernard Antwi Boasiako was malicious in his description of him as a thief while participating in a discussion on Wontumi TV and FM.
We filed the writ in regards to defamation, so we obviously cannot agree with any of the court’s conclusions. At least according to the decision that was read in court, Mr. Wontumi’s statement was not made with malice, and the court did not think that he had endorsed a substantive relief on our writ.
We will unquestionably file an appeal, and we’ll go from there with a quick appeal.
On July 28, 2022, the Kumasi High Court dismissed a $10 million defamation lawsuit filed by Dr. Ekwow Spio-Garbrah, a former trade and industry minister, against Bernard Antwi Boasiako, also known as Chairman Wontumi, the Ashanti Regional Chairman of the New Patriotic Party.
Dr. Spio-Garbrah was also given a GH150,000 cost award by the court.
